TERMS OF SERVICE (TOS)

| WebPro Solutions does not allow any of the following content to be stored on its servers: |

|
 Illegal Material |
|
| This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. |
|
|
| Adult Material |
|
| Includes all pornography, erotic images, or otherwise lewd or sexual content, or links to adult content elsewhere. The designation of "adult material" is left entirely to the discretion of WebPro Solutions. |
|
|
| Child Pornography |
|
WebPro Solutions will cooperate fully with any criminal investigation into a Customer's violation of the Child Protection Act of 1984 concerning child pornography, or any other applicable international, federal, state, or local law that prohibits child pornography. Customers are ultimately responsible for the actions.
According to the Child Protection Act, child pornography includes photographs, films, video, or any other type of visual presentation that shows a person who is or is depicted as being under the age of eighteen years and is engaged in or is depicted as engaged in explicit sexual activity, or the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ or the anal region of a person under the age of eighteen years or any written material or visual representation that advocates or counsels sexual activity with a person under the age of eighteen years. |

| Warez |
|
| Includes pirated software, ROMS, emulators, freaking, hacking, and password cracking, IP spoofing and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. |
|
|
| Other |
|
| Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. |

|
| Acceptable Use Policy |
|
You shall not use the services or the servers provided by the Supplier to:
- send unsolicited commercial or bulk email to any party for any reason which may or may not result in a complaint.
- access, or attempt to access a computer or network resource that you are not authorized to access.
- distribute, or make available in any way to any party intellectual property that requires some method of authorization to sell or distribute, which you do not have.
- store, transmit, create, or examine any pictures, realistic or not, of humans, anthropomorphic depictions of human-like creatures, or images suggesting humans that are under the age of 18 years in an either implied or actual pornographic picture.
- forge email headers or TCP/IP packet headers or engage in spoofing.
- distribute worms, trojans, or viruses, or commit or attempt to commit any denial of service attack against any computer, network, or individual.
- violate export controls on any software or intellectual property.
- IRC access is forbidden
- War Bots/X-DCC are not allowed
- No bouncers are allowed
- Shell hosting companies can not be run from our service
- use any peer to peer programs.
- if you are dossed the Supplier reserve the right to suspend your account to limit the attack. If you are found to have caused the DDOS your account may be suspended or cancelled and you billed.
- Abuse towards the Supplier's staff in the form of verbal abuse or anything else that we deem to be offensive may result in cancellation of your account
- No free hosting companies are allowed on our service due to the high risk of abuse by end clients
- Game servers such as CounterStrike, Half Life 2 and similar are not allowed due to the amount of CPU
resources they take
- Proxies are tolerated but should they cause issue the supplier has the right to suspend them and inform the client they need to upgrade or move the proxy
(" Acceptable Use Policy")
For the avoidance of doubt, the Supplier does not monitor, and will have no liability for the contents of, any communications transmitted by virtue of the services. Notwithstanding the aforesaid the Supplier reserves the right to withdraw the service without compensation to the you in the event of a breach of the Acceptable Use Policy and any such breach shall be treated as a fundamental breach of contract. |

| WebPro Solutions No-Spam Policy (NSP). |
|
WebPro Solutions takes a zero tolerance approach to the sending of Unsolicited Email (SPAM). Very simply this means that Clients of WebPro Solutions may not use or permit others to use our service for sending SPAM Emails. Clients of WebPro Solutions may not host, or permit hosting of, sites or information that is advertised by SPAM from other services. Violations of this policy carry severe penalties, including termination of service.
If a customer is found to be in violation of our SPAM policy, WebPro Solutions may, at its sole discretion, restrict, suspend or terminate a customer's account. In addition, WebPro Solutions may impose a £500 penalty for each spam policy violation. WebPro Solutions solely reserves the right to refuse or cancel service to known spammers. Lastly, WebPro Solutions reserves the right to determine what violates this policy. As such, any violation may result in cancellation of services without refund.
For example, if you even attempt to send 1000 spam emails through our servers, a collection agency will attempt to collect £5000 (GBP) from you. The easiest way to avoid this penalty charge is to NOT send spam. |

| Resource Usage |
|
We do not allow background-running programs. This includes any IRC related software such as bouncers and bots. We provide a hosting service not a shell service. You are not allowed to compile and run software on our hosting servers.
You are free to use any scripts (such as php, cgi or perl) you wish provided they do not affect the normal operations of the server and they are not mentioned specifically below.
Scripts that are commonly known for causing server disruption include large cgi-based message forums, auctions, galleries, and banner exchanges. In the event a script affects normal server and/or administrative operations, WebPro Solutions reserves the right to disable the account pending client cooperation and resolution.
Scripts we do not allow include:
- Chat servers/scripts of any kind are strictly prohibited.
- Formmail scripts using the filename "formmail" are prohibited.
Formmail and contact forms are acceptable providing the script is not named "formmail" for its filename and providing that you maintain the latest version of the script and it remains secure and un-abused by spammers.
For security reason we do not allow to have remote access to our MySQL server. |

| Personal Account |
|
| Personal accounts are to be solo used by that holder only. The holder is responsible for the security and confidentiality of the holders username and password. |
|
| Abuse of WebPro Solutions Staff or Support Personnel. |
|
At WebPro Solutions, we take pride in providing excellent service to all of our customers. It is our policy always to treat our customers with the highest level of respect and courtesy. In return, we expect the same respect and courtesy from you.
If our staff feels that you are consistently engaging in abusive content toward them, or addressing them in a demeaning or rude manner, your account(s) may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for abusive conduct, customers will be given two (2) days' notice to find a new Web host. We will NOT issue any refunds for pre-paid service.
Abusive conduct includes, but is not limited to, the following behaviors:
- Repeatedly addressing members of our staff in a demeaning or rude manner;
- Using profanity in any oral or written communications with our staff, by any medium of communication, including but not limited to e-mail, instant messages, chat, text messaging, fax, postal mail, telephone, voice over Internet Protocol (VoIP), or in-person communication;
- Yelling or shouting at our staff;
- Deliberately using all capital (uppercase) letters in any written communication to our staff;
- Insulting our staff because of their personal characteristics, or on the basis of their race, ethnicity, national origin, sex, sexual orientation, religion, or housing or economic status; or
- Deliberately providing false information to our staff for the purpose of harassing them or wasting their time.

| WebPro Solutions Rights |
|
WebPro Solutions reserves the right to refuse its service and / or access to its servers to anyone.
WebPro Solutions reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. However if a customer contravenes WebPro Solutions terms of service a refund will not be issued in the event of a cancellation. Customers may cancel their account at any time. Fees charged on a prepay basis are non-refundable. |
